Terms of Service — DocNotes

⚠️ Important: Doctor Notes is a personal note-taking tool, not a medical device or record system. AI summaries may contain errors — always verify information with your healthcare provider.

1. Acceptance of Terms

By downloading, installing, or using the Doctor Notes app ("App") or visiting docnotes.io ("Site"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App or Site.

We may update these Terms from time to time. Continued use of the App after changes constitutes acceptance of the updated Terms.

2. Description of Service

Doctor Notes is a personal note-taking and summary tool that helps you remember what was discussed during medical appointments. The App records audio on your device, transcribes it using Apple’s on-device speech recognition, and generates a plain-language summary using AI.

🏥 Doctor Notes is not a medical device, electronic health record (EHR) system, or clinical documentation tool. It is not a substitute for professional medical advice, diagnosis, or treatment. AI-generated summaries may contain errors, omissions, or inaccuracies — always verify the content with your healthcare provider.

3. Recording Consent & Legal Compliance

Recording laws vary by location. In many jurisdictions, all parties to a conversation must consent to being recorded (“all-party consent” or “two-party consent” laws).

You are solely responsible for ensuring you comply with all applicable recording laws in your jurisdiction before recording any conversation.
You must inform your doctor and any other parties present that you intend to record the appointment and obtain their consent where required.
DocNotes accepts no liability for unlawful recordings made using the App. By using the recording feature, you represent that you have obtained all necessary consents.

4. Subscriptions & Pricing

Doctor Notes offers the following subscription plans:

All prices are in USD and are subject to change. Current pricing is always shown in the App.
Subscriptions are managed and billed by Apple through the App Store. Payments are charged to your Apple ID account.
Subscriptions auto-renew unless cancelled at least 24 hours before the end of the current billing period.
To cancel, go to your iPhone Settings → [Your Name] → Subscriptions → Doctor Notes.
Refunds are handled by Apple in accordance with Apple’s App Store refund policy.
Care Circle members who receive summaries do not need a paid subscription — only the account owner pays.

5. Care Circle & Email Summaries

The Care Circle feature allows you to invite family members or caregivers to receive visit summaries via email.

By adding a person to your Care Circle, you authorize DocNotes to send visit summaries to their email address on your behalf.
You represent that you have each Care Circle member’s consent to receive these emails.
Care Circle members may unsubscribe from emails at any time using the unsubscribe link included in each email.
You are responsible for keeping your Care Circle list accurate and up to date.

6. Acceptable Use

You agree not to use the App or Site to:

Record conversations without the required consent of all parties
Store, share, or transmit information that infringes any third party’s rights
Attempt to reverse engineer, decompile, or extract the source code of the App
Use the App for any unlawful purpose or in violation of any applicable laws
Attempt to gain unauthorized access to our systems or other users’ data
Resell, redistribute, or sublicense access to the App

7. Intellectual Property

The App, Site, and all associated content, trademarks, and intellectual property are owned by DocNotes. You are granted a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes in accordance with these Terms.

You retain ownership of all content you create using the App (visit notes, summaries, patient profiles). By using the App, you grant us a limited license to process that content solely to provide the service (e.g., generating summaries via AI).

8. Disclaimer of Warranties

THE APP AND SITE ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY OF AI-GENERATED CONTENT.

We do not warrant that the App will be uninterrupted, error-free, or that AI summaries will be accurate or complete. Medical information in summaries should always be verified with your healthcare provider.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, DOCNOTES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE APP OR SITE, INCLUDING BUT NOT LIMITED TO RELIANCE ON AI-GENERATED SUMMARIES FOR MEDICAL DECISIONS.

Our total liability for any claim arising from or related to these Terms or your use of the App is limited to the amount you paid to us in the 12 months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless DocNotes and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or in connection with: (a) your use of the App; (b) your violation of these Terms; (c) your violation of any applicable recording laws; or (d) any content you create, share, or transmit through the App.

11. Termination

You may stop using the App at any time. We may terminate or suspend your access to the App at our discretion if you violate these Terms or for any other reason with reasonable notice.

Upon termination, you may export your data using the in-app export feature before your access ends. Provisions that by their nature should survive termination (including disclaimers, limitations of liability, and indemnification) will survive.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Texas, United States, without regard to its conflict of law provisions. Any disputes will be resolved in the courts located in Texas.

13. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by updating the “Last updated” date at the top of this page and, where appropriate, by notification within the App. Your continued use of the App after changes take effect constitutes your acceptance of the new Terms.
